Termination of Services
TERMINATION OF SERVICES
Section 1.
The service of a faculty member may be terminated due to any of the
following reasons:
a) Compulsory retirement upon reaching the age of 65 or due to physical/ mental disability.
b) Financial exigencies of the university.
c) Phasing out of the Program in which the individuals is engaged.
d) Dismissal for cause.
“Cause” shall be taken to mean any of the following offenses:
1. Unsatisfactory teaching performance rating from students and department Chairman/Dean for three (3) consecutive terms;
2. Dishonesty, fraud, or willful breach of the trust reposed him by the university thru its duly constituted authorities.
3. Oppression or commission of a crime against the person officials, students or any component element therein;
4. Misconduct which directly or indirectly affects the integrity of the university;
5. Neglect of duty, or performance inefficiency (i.e., excessive absences or tardiness);
6. Disgraceful or immoral conduct;
7. Violation of university rules and regulations, circulars, memorandum, etc., or disobedience of an order of university authorities in connection with his work (habitually late in the submission of grade sheets):
8. Improper or unauthorized solicitations or collections of contributions from, and selling of tickets, materials, insurance, etc. to students.
9. Conviction of a crime.
10. Inciting unrest within the campus;
11. Violation of the Code of Professional Ethics
12. Violation of R.A. 916 or Comprehensive Dangerous Drugs Act.
13. Violation of Sexual Harassment Law
14. Violation of HIV/AIDS Workplace Policy Program
15. Violation of Workplace Policy and Program on Hepatitis B
16. Violation of Workplace Policy and Program on Tuberculosis (TB) Prevention and Control
17. Violation of the Anti-Bullying Law
18. Violation of Data Privacy Law (RA-10173)
19. Other causes analogous to the foregoing as provided for in this Faculty Manual for faculty members as may be provided for in the regulations prescribed by the Commission a High Education (CHED).
Section 2.
A violation of any of the reasons enumerated above shall be properly investigated and decided within a period of thirty (30) days from the filing of a formal complaint. A faculty member under investigation may undergo preventive suspension without pay during the pendency of the case.
Section 3.
A faculty member dismissed for cause shall forfeit his right to any and all emoluments, privileges, and benefits which may have accrued during his past service.
